MP3tunes Shielded In Part By DMCA, Judge Maintains

Law360, San Diego (October 25, 2011, 10:56 PM EDT) -- A New York federal judge on Tuesday granted EMI Group Ltd.’s request to reconsider a ruling that online music storage service MP3tunes LLC was entitled to safe harbor protection under the Digital Millennium Copyright Act — but his amended order backed his earlier findings.

U.S. District Judge William Pauley III granted MP3tunes’ summary judgment motion that it was shielded by the copyright law’s safe harbors, except for hundreds of songs identified in EMI affiliates’ takedown notices that were not removed from users’ online lockers.
