AARP Backs Dallas News Workers In 5th Circ. Age Bias Suit

Law360, New York (October 27, 2011, 5:07 PM EDT) -- The AARP filed an amicus brief Wednesday with the Fifth Circuit, backing a group of laid-off employees of The Dallas Morning News alleging age bias and calling the lower court's rejection of their claims a "superficial" and flawed reading of the Age Discrimination in Employment Act.

The former reporters, editors, copy desk staff and newspaper support staffers are challenging a lower court's finding that they failed to sufficiently prove that the newspaper's subjective considerations in a 2004 round of layoffs disproportionately affected older workers. The 145-page...
