BMW Peels Out Of Class Action Over Engine Defects

Law360, New York (October 31, 2011, 5:28 PM EDT) -- A New Jersey federal judge on Monday dismissed a putative class action that accused BMW of North America LLC of obscuring a serious fuel injection problem in its N54 engine and failing to adequately correct the hazard.

U.S. District Judge Susan D. Wigenton granted BMW's motion to dismiss, ruling that the three lead plaintiffs lacked standing to bring their breach of warranty and New Jersey Consumer Fraud Act claims over the engine, which the plaintiffs allege contains a defective fuel injection system and high-pressure fuel pump...
