Avon Workers Say Wage Suit Belongs Back In State Court

Law360, New York (November 3, 2011, 6:37 PM EDT) -- A group of Avon Products Inc. employees asked a California federal court on Wednesday to remand a putative wage-and-hour class action against Avon and temporary staffing agency Spherion Staffing LLC to state court, saying the potential damages are too low to warrant federal jurisdiction.

The plaintiffs' motion argues that the suit, alleging wage-and-hour and meal break violations, was removed based on incorrect calculations by the defendants. Total potential damages are closer to $4.36 million, and not the $5 million required for federal jurisdiction, the motion says....
