9th Circ. Revives Shuttle Driver FLSA Action

Law360, New York (November 3, 2011, 6:12 PM EDT) -- The Ninth Circuit on Thursday revived a class action claiming airport transportation service SuperShuttle International misclassified drivers as independent contractors, saying a federal court decision on the matter would not interfere with the California Public Utilities Commission's regulatory authority.

In a published decision, the appeals court reversed U.S. District Judge Jeffrey S. White's ruling that his court lacked jurisdiction to determine whether the shuttle van drivers should be considered employees or independent contractors under California labor law.
