Coconut Water False Ad Suit Sent Back To State Court

Law360, New York (November 7, 2011, 6:19 PM EST) -- A federal judge on Friday sent back to California state court a consumer class action alleging coconut water producer All Market Inc. misrepresented the health benefits of its product, saying All Market overvalued the damage amount at issue in its bid to move the suit to federal court.

U.S. District Judge John F. Walter ruled that All Market had not proved that the amount in controversy would exceed $5 million, as required for removal by the Class Action Fairness Act.
