KB Home Sales Staffers Win 2nd Chance In OT Action

Law360, New York (November 14, 2011, 8:37 PM EST) -- A Texas federal judge backtracked Monday in a putative class action against KB Home seeking overtime pay for thousands of sales staff members, reversing his July order that dismissed the suit and approving the plaintiffs' request for reconsideration.

In reviving the case, U.S. District Judge Kenneth Hoyt vacated his July order ruling that sales staffers who worked in KB Home offices in newly developed subdivisions were legally “outside sales staff,” a group that has long been exempted under national overtime laws.
