Fox Asks 2nd Circ. To Kill Screenwriter's 'Alien' Suit

Law360, New York (November 15, 2011, 5:34 PM EST) -- Twentieth Century Fox Film Corp. asked the Second Circuit on Monday to uphold the dismissal of a copyright infringement and breach of contract suit brought by a screenwriter who claims Fox and others stole his idea for the 2004 film “Alien vs. Predator.”

Fox argues in a brief that Circuit Judge Denny Chin had indeed ruled correctly when he granted summary judgment to Fox in March, finding that no reasonable jury could find a striking similarity between AVP and plaintiff James Muller's screenplay “The Lost Continent.”...
