Nutella False Ad Plaintiffs Granted Class Status

Law360, New York (November 15, 2011, 6:23 PM EST) -- A California federal judge on Monday certified a statewide class of plaintiffs in a suit accusing Ferrero USA Inc. of misleadingly promoting its hazelnut spread Nutella as a healthy breakfast for children even though it contains high levels of fat and sugar.

The class includes “all persons who, on or after Aug. 1, 2009, bought one or more Nutella products in the state of California” for personal use, according to an order from U.S. District Judge Marilyn L. Huff.
