Fed. Circ. Backs US In Low-Income Housing Row

Law360, New York (November 21, 2011, 5:04 PM EST) -- The Federal Circuit ruled Monday that federal laws making it harder for a low-income housing provider to prepay the last half of its mortgage — as previous legislation would have allowed it to do freely — did not result in a regulatory taking or breach of contract.

A two-judge majority affirmed a U.S. Court of Federal Claims ruling that CCA Associates' breach of contract claim was foreclosed by the Federal Circuit's Cienega line of decisions, which dealt with similar issues to the immediate case, but reversed...
