Chubb Foes Stymied Again In Class Cert. Roller Coaster

Law360, New York (November 22, 2011, 8:25 PM EST) -- A New York federal judge on Tuesday denied certification for the second time in two coordinated putative class actions alleging The Chubb Corp. improperly raised homeowners' insurance premiums in violation of its insurance contracts.

After denying certification for the first time in January 2010, the plaintiffs appealed and the Second Circuit vacated U.S. District Judge Harold Baer's decision, remanding the cases and instructing Judge Baer to reconsider certification in light of a recent U.S. Supreme Court decision in Wal-Mart Stores Inc. v. Dukes.
