Judge OKs Kinder Morgan Deal In Water Pollution MDL

Law360, New York (November 23, 2011, 2:34 PM EST) -- Unswayed by Shell Oil Co.'s objections, a New York federal judge on Tuesday greenlighted a settlement between Kinder Morgan Energy Partners LP and the City of Merced Redevelopment Agency in multidistrict litigation over groundwater contamination from methyl tertiary-butyl ether.

The settlement resolves claims that Kinder Morgan fouled the Merced RDA's property by releasing gasoline containing MTBE or tertiary butyl alcohol from its pipeline into the groundwater in Merced, Calif. The RDA's suit is one of dozens tied together in an MDL accusing major oil companies and...
