Software Co. Loses Bid To Force Groupon Name Change

Law360, New York (November 28, 2011, 8:26 PM EST) -- A California court on Monday denied a request by Groupion LLC for an order barring online discount provider Groupon Inc. from operating under its own name in a trademark fight between the two similarly named companies.

U.S. District Judge Jeffrey S. White found that the customer relations software developer had failed to prove sufficiently that Groupon’s trademark was confusingly similar to its own, nixing a bid for a preliminary injunction as well as one for summary judgment.
