Writer Has No IP Stake In Topps Sci-Fi Game: 9th Circ.

Law360, New York (November 29, 2011, 1:32 PM EST) -- The Ninth Circuit on Monday rejected an appeal filed by a science fiction writer who said Topps Inc.'s use of his copyrighted backstory in its “Battletech” game franchise conferred to him joint ownership of the franchise.

The appeals court said that Scott Malcomson had failed to present sufficient factual evidence at trial to demonstrate that his relatively minor contributions to the Battletech mythology qualified him as a joint owner of the gaming franchise.
