Perdue 'Humane' Label Challengers Out Of Luck For Now

Law360, New York (November 30, 2011, 5:17 PM EST) -- A New Jersey federal judge on Wednesday dismissed a putative class action accusing Perdue Farms Inc. of misleading consumers by advertising factory-farmed chicken products as humane, saying that the plaintiffs lacked standing on certain claims and that others were insufficiently pled.

Named plaintiffs Nadine Hemy and Nancy Connor will be allowed to try to correct some of the problems in an amended complaint, but a claim accusing Perdue of breaching the New Jersey Consumer Fraud Act by labeling its products as “Raised Cage Free” and another...
