California Court Will Consider Only Two Cree Patents

Law360 (July 9, 2007, 12:00 AM EDT) -- A California district court threw out several counts in a patent suit on Monday, filed by LED company Bridgelux Inc. against rival company Cree Inc. and Boston University over six of the defendants' patents related to producing semiconductors.

Since the two companies' patent dispute includes three cases in separate courts, Judge Phyllis Hamilton of the Northern District of California relied on a “first to file” rule for four of the patents. She wrote that some counts in the complaint should be decided in the other courts,...
