Calif. Appeals Court Nixes Faulty Nissan Odometer Suit

Law360, New York (December 5, 2011, 10:30 PM EST) -- A California appeals court on Monday upheld a lower court's decision to toss a putative class action accusing Nissan North America Inc. of breaching contracts by marketing and producing allegedly faulty odometers, finding that the car manufacturer complied with state laws.

In a unanimous opinion, a three-judge panel for the California Court of Appeal, Second Appellate District, ruled that the odometers in question, which were alleged to overestimate driven miles by about 2 percent, complied with California standards regulating the accuracy of passenger vehicle odometers....
