Apple Buyer Urges 9th Circ. To Revive False Ad Action

Law360, Los Angeles (December 6, 2011, 5:16 PM EST) -- An attorney for a California computer buyer asked the Ninth Circuit on Tuesday to revive putative class action claims that Apple Inc. falsely advertised its iBook G4 laptops as durable and rugged while knowing that thousands had defective logic boards.

“In essence, what Apple said was that it was making a Land Rover for people who use computers,” buyer Alan Vitt’s attorney Henry Rossbacher told a three-judge appeals panel. “What it delivered was a defective Ford station wagon.”
