Buyer Sour Over Ford Warranty In 9th Circ. Lemon Law Suit

Law360, Los Angeles (December 6, 2011, 8:29 PM EST) -- An attorney for a California Ford buyer asked the Ninth Circuit on Tuesday to revive a putative class action claiming Ford Motor Services Co. violated the state’s auto “lemon law” by selling extended warranties that overlapped with the original manufacturer’s warranty.

Plaintiff Noruma Orue’s attorney James Kostas told the appellate panel Tuesday that California’s Beverly-Song Consumer Warranty Act bars carmakers from selling extended warranties that include any of the same coverage contained in the manufacturer’s warranty, even where the extended warranty offers greater protection.
