Deputies Urge 9th Circ. To Revive OT Action

Law360, Los Angeles (December 9, 2011, 6:03 PM EST) -- A putative class of Orange County deputy sheriffs and district attorney investigators urged the Ninth Circuit on Friday to revive their suit accusing the county of shortchanging civil servants on their overtime pay by hundreds of dollars each pay period.

The deputies told a three-judge panel that the county's payroll calculations don't factor in premiums and other bonuses when computing the deputies' overtime pay, a violation of the Fair Labor Standards Act which requires employers to pay a regular rate of pay.
