Judge Mulls Class Cert. In Gerber Phthalate Action

Law360, Los Angeles (December 12, 2011, 8:51 PM EST) -- A California federal judge on Monday indicated that she would certify a statewide class of consumers who purchased tagless garments from Gerber Childrenswear LLC that allegedly contained phthalates.

U.S. District Judge Dale S. Fischer said she was inclined to certify a class of Californians who purchased the Gerber products for their children but mulled over exactly how many consumers — or garments — should be included in the litigation.
