Baby Food Packager Can't Make Spoilage Suit Go Bye-Bye

Law360, New York (December 14, 2011, 7:28 PM EST) -- A Georgia federal judge on Monday refused to dismiss Michigan food packager Liquid Manufacturing LLC from a suit brought by Target supplier Nurture Inc. over recalled baby food that Liquid allegedly mispackaged.

Liquid had argued that since its sole packaging facility is based in another state, the court had no jurisdiction over the company. But enough of the company's business occurs in Georgia to void that argument, U.S. District Judge Robert L. Vining Jr. said in an order handed down Monday.
