Apotex Wins Appelate Reversal In Ofloxacin Case

Law360 (July 12, 2007, 12:00 AM EDT) -- The U.S. Court of Appeals for the Federal Circuit has reversed a lower court's decision that Canadian generic drug maker Apotex Corp. infringed a patent covering antibacterial ear medicine, ruling that Daiichi Sankyo Co. Ltd.'s patent was invalid due to obviousness, and clearing the way for Apotex to market generic ofloxacin ear drops.
