9th Circ. Reverses Louis Vuitton Customer Info Ruling

Law360, New York (December 15, 2011, 6:16 PM EST) -- The Ninth Circuit on Thursday reversed a lower court ruling denying Louis Vuitton North America Inc.'s motion to remove to federal court a class action alleging it illegally recorded personal information when accepting credit card payments.

A three-judge panel stated that a California federal court had erred in finding that Louis Vuitton had not proven it could be facing more than $5 million in claims, in an unpublished opinion.

The panel said that the complaint had asked for penalties of up to $1,000 for each violation...
