Fed. Circ. Closes Door On Nonmarket Economy Tire Duties

Law360, New York (December 19, 2011, 9:03 PM EST) -- The Federal Circuit rejected challenges from the U.S. government, Titan Tire Corp. and Bridgestone Americas Inc. on Monday to a decision that nixed countervailing duties on two Chinese off-road tire producers, ruling that countervailing duties could not be applied to goods from nonmarket economy countries.

A three-judge panel of the Federal Circuit issued a 26-page opinion that rejected appeals from the federal government and U.S. manufacturers following an Oct. 1, 2010 judgment from U.S. Court of International Trade.
