Law360, New York (January 6, 2012, 1:52 PM EST) -- On Dec. 19, 2011, the U.S. Court of Appeals for the Federal Circuit issued a landmark decision invalidating the application of U.S. anti-subsidy, or countervailing duty, law to nonmarket economy countries, including China. Barring intervention by the U.S. Supreme Court or the U.S. Congress, this decision will halt or overturn scores of CVD proceedings involving China, profoundly impacting the administration of trade remedies in the United States. However, an immediate suspension of pending investigations and reviews or unwinding of existing orders is unlikely.
