Law360, New York (December 22, 2011, 1:58 PM EST) -- OneBeacon America Insurance Co. on Wednesday claimed it had no duty to defend NextG Networks Inc. against a California state board's investigation into whether NextG insufficiently maintained utility poles that fell and sparked a nearly 4,000-acre fire in Malibu, Calif., in 2007.
In a motion to dismiss filed in California federal court, OneBeacon argued that the investigation by the California Public Utilities Commission did not constitute a suit under NextG's insurance policy or California insurance law.
