I Can't Believe It's Not Properly Labeled Butter: Suit

Law360, New York (December 23, 2011, 2:17 PM EST) -- Supermarket chain Kroger Co. and Challenge Dairy Products Inc. were slapped with a proposed class action in California state court Wednesday by a consumer who claims Challenge purposely mislabels its dairy spreads to trick customers into thinking they are buying butter.

The suit, filed in Los Angeles Superior Court, claims Challenge is violating California's Milk and Milk Products Act under the Food and Agriculture Code, which lays out strict requirements for the labeling of butter and butter-like products including margarine and spreads.
