2nd Circ. Stamps Out Fire Loss Action Against Allstate

Law360, New York (January 3, 2012, 5:01 PM EST) -- The Second Circuit on Tuesday affirmed the dismissal of a proposed class action against Allstate Insurance Co. over its reimbursement practices for fire-related property damages, ruling the insurer had not violated New York law or its own policy.

Policyholders Thomas D. Woodhams and Charlene Connors had neglected to provide evidence to support their claim that Allstate's policy mandating that repairs be completed within 180 days violated New York state's insurance law, the Second Circuit ruled in a summary order affirming the dismissal.
