9th Circ. Tosses Wal-Mart Managers' Bid For Class Cert.

Law360, New York (January 3, 2012, 9:22 PM EST) -- The Ninth Circuit on Friday affirmed the denial of class certification for a group of current and former assistant managers for Wal-Mart Stores Inc. and vacated its previous ruling in the case in light of the Supreme Court’s decision in Wal-Mart Stores Inc. v. Dukes.

In 2008, the Ninth Circuit had ruled that U.S. District Judge Dale S. Fischer had misapplied a circuit court precedent when he denied class certification in the suit, which claimed that Wal-Mart violated California’s labor laws by not allowing its assistant...
