Strip Club Co. Loses Trademark Suit Over Rhino Handguns

Law360, Los Angeles (January 3, 2012, 3:51 PM EST) -- A California federal judge on Tuesday tossed a trademark and unfair competition suit brought by adult entertainment chain Spearmint Rhino Cos. Worldwide Inc. against Chiappa Firearms Ltd., finding consumers are unlikely to be confused by a rhinoceros silhouette stamped on Chiappa handguns.

U.S. District Judge Manuel L. Real granted the gun maker’s motion to dismiss the lawsuit alleging the outlined ungulate emblazoned on the handle of its unconventional new Rhino revolver infringes Spearmint Rhino’s federally registered rhino-head trademark and violates state unfair competition laws.
