Mutual Contractors Can't Bring Labor Claims: Calif. Court

Law360, New York (January 4, 2012, 7:19 PM EST) -- A California appeals court on Friday tossed a putative employment class action brought by Mutual of Omaha Insurance Co. insurance agents, finding the agents were independent contractors and unable to bring claims under state labor laws.

In a published opinion, the appeals court upheld the lower court’s use of common law tests to determine that the insurer’s agents were independent contractors, and not employees, as a matter of law.
