5th Circ. Revives Dyncorp FCA Retaliation Suit

Law360, New York (January 6, 2012, 1:59 PM EST) -- The Fifth Circuit on Thursday revived a False Claims Act suit accusing security contractor Dyncorp International Inc. of firing a former senior employment manager as retaliation, finding a lower court used the wrong statute of limitations period to nix the complaint.

In the suit, Michael Riddle accused Dyncorp of wrongly terminating his employment after he protested the company's inaction on its contract with the U.S. government to create a database of Americans with prior law enforcement backgrounds.
