Nonprofit Defends Against Righthaven Appeal In 9th Circ.

Law360, New York (January 9, 2012, 7:19 PM EST) -- An immigrant advocacy organization lodged a brief in the Ninth Circuit on Friday arguing against an appeal by copyright holding company Righthaven LLC, maintaining a lower court did not err when it granted summary judgment to the nonprofit group.

The Portland, Ore.-based Center for Intercultural Organizing filed its brief in the U.S. Court of Appeals for the Ninth Circuit, alleging the district court was correct in concluding that the nonprofit group’s posting of a newspaper article on its website constituted fair use.
