Ferrero To Put $2.5M In Customers' Jar Over Nutella Ads

Law360, New York (January 11, 2012, 8:24 PM EST) -- Ferrero USA Inc., the New Jersey-based maker of Nutella, agreed Tuesday to pay $2.5 million to customers and revise its multimedia ad campaign touting the creamy, sweet chocolate hazelnut spread as a healthy breakfast item to settle a class action claiming its ads are misleading.

The agreement, if approved by a New Jersey federal judge, will end class actions consumers Marnie Glover and Jayme Kaczmarek brought against Ferrero in February that accused the confectionery producer of violating the New Jersey Consumer Fraud Act with television, print...
