Kraft Crumbles Triscuit Workers’ Don, Doff Action

Law360, New York (January 13, 2012, 5:54 PM EST) -- An Illinois federal judge on Thursday tossed a class action against Kraft Foods Global Inc., finding that a long history of forgoing don-doff pay prevented employees at a Triscuit processing plant from recovering such compensation now.

U.S. District Judge Virginia M. Kendall granted Kraft’s motion for summary judgment, saying Section 203 of the Fair Labor Standards Act prohibited employees from recovering don-doff pay when there was a long-standing custom in place excluding the compensation.
