NY Appeals Panel Keeps Suit Over Zoning Alive

Law360, New York (January 13, 2012, 2:03 PM EST) -- A New York appeals court on Thursday upheld the denial of architect Edward I. Mills & Associates Architects PC's motion to dismiss a malpractice suit brought by developer Assouline RitzI LLC regarding zoning issues that prevented the planned development of a New York City building.

The state appeals court panel said the case should proceed to trial, where Assouline would be entitled to recover expenses that it could prove were incurred as a result of reliance on EIM's allegedly faulty advice to go forward with a plan to add six new floors to the building at 16 Warren St. in Manhattan...
