2nd Circ. Affirms Broker-Dealer's $1.6M Fraud Judgment

Law360, New York (January 19, 2012, 6:44 PM EST) -- The Second Circuit on Thursday upheld a $1.6 million judgment against a fraudster convicted in a scheme to inflate the value of an online gaming company's securities, saying a lower court had appropriately imposed the penalty.

The three-judge panel's summary order was the second decision the court has made on the sentence since David Rutkoske was found guilty by a New York federal jury in February 2006 and sentenced to nine years in prison as well as ordered to pay restitution to victims.
