Dallas BBQ Boxes Up Servers' OT Pay Suit

Law360, New York (January 19, 2012, 5:01 PM EST) -- Barbecue chain Dallas BBQ agreed on Wednesday to settle a putative class action lodged in New York federal court by tipped employees who claimed the restaurants failed to pay them proper overtime and spread-of-hours pay.

U.S. Magistrate Judge Kevin Nathaniel Fox preliminarily approved the settlement, which calls for Dallas BBQ to pay $382,400 to resolve the litigation.

The suit was filed by former Dallas BBQ waiter Candy Eric Carino in November 2010. It alleged violations of both the Fair Labor Standards Act and New York state...
