Samsung Galaxy Defect Action Gutted But For 1 Claim

Law360, New York (January 19, 2012, 10:00 PM EST) -- A Texas federal judge on Thursday threw out all but one claim in a putative class action accusing Samsung Telecommunications America LLC of selling and failing to fix defective Galaxy S phones, but allowed the plaintiffs to replead their case.

Chief District Judge Sidney A. Fitzwater tossed the plaintiffs' two breach of express warranty claims, one breach of implied warranty claim, both money-had-and-received claims and Magnuson-Moss Warranty Act violation claims.
