Ferrero Closes Lid On Nutella False Ad Suit

Law360, New York (January 20, 2012, 5:21 PM EST) -- Ferrero USA Inc. on Thursday agreed to pay consumers $550,000 and make changes to the labeling and advertising of its chocolate hazelnut spread Nutella to settle a class action claiming that it misleadingly promoted the product as nutritious despite its high levels of fat and sugar.

Under the proposed settlement in California federal court, Ferrero will deposit the settlement amount into an interest-bearing account that will reimburse $4 to anyone who purchased a jar of Nutella in California since Aug. 1, 2009, up to a maximum...
