US Slaughterhouse Law Preempts Calif. Ban: High Court

Law360, New York (January 23, 2012, 12:25 PM EST) -- The U.S. Supreme Court ruled Monday that federal law expressly preempts a California ban on the slaughter and inhumane treatment of sick or injured animals, unanimously reversing the Ninth Circuit in National Meat Association v. Harris.

The law, passed in 2008, mandates that animals too weak to stand or walk without assistance must be immediately euthanized, and adds criminal penalties for selling or butchering nonambulatory animals.
