Duane Reade Managers Granted Cert. In OT Suit

Law360, New York (January 27, 2012, 7:27 PM EST) -- A New York federal judge on Friday handed an early victory to Duane Reade Inc. assistant store managers who claim they are wrongly exempted from overtime pay, conditionally certifying their collective action against the pharmacy chain.

Over Duane Reade's objections, U.S. District Judge J. Paul Oetken said lawyers for the plaintiffs could begin reaching out to current and former assistant store managers at the New York City-based chain's approximately 250 stores to let them know about the suit.
