'Elder Scrolls' Class Action Should Be Unplugged: Judge

Law360, Chicago (January 30, 2012, 7:44 PM EST) -- A Florida magistrate judge's report recommended the dismissal Monday of a proposed class action accusing the makers of the video game "Elder Scrolls" of deceptively marketing and selling a defective product, finding the claims had been brought under the wrong state's law.

In a report signed Friday and entered in the docket Monday, U.S. Magistrate Judge David A. Baker also said that lead plaintiff and Florida resident Lawrence Walewski's motion for class certification in his suit against Maryland-based ZeniMax Media Inc. and subsidiary Bethesda Softworks LLC...
