Travelers Battles W.Va. Plant Runoff Pollution Claims

Law360, New York (February 1, 2012, 2:56 PM EST) -- Travelers Property Casualty Co. of America sued a petroleum coke refiner in New York state court Monday, alleging that it isn't liable for damages from pollution class actions filed over dirt runoff against a formerly insured West Virginia plant.

Travelers says it is exempt from defending Rain CII Carbon LLC against four class actions stemming from dirt runoff that started in 1958 at a Moundsville, W.Va., plant. The insurer also claims its liability for damages is limited or absolved because of pollution and causation clauses written...
