Prevailing Parties Can Recover Expert Fees: Calif. Court

Law360, New York (February 1, 2012, 8:53 PM EST) -- A California appeals court said Tuesday that a prevailing defendant can recover fees paid to a plaintiff's expert, rejecting an argument from an ex-worker who unsuccessfully sued Wet Seal Inc. that Wet Seal could only be reimbursed for its own experts' fees.

A three-judge state appellate panel affirmed a lower court's decision to deny wrongful termination suit plaintiff Sally Chaaban's motion to tax costs and allow clothing retailer Wet Seal to recover nearly all of the $29,770.67 it sought after obtaining a winning jury verdict....
