EDS Asks Court To Toss Claims In 401(k) Suit

Law360 (July 25, 2007, 12:00 AM EDT) -- Technology services company Electronic Data Systems Corp. filed a motion Tuesday urging a court to dismiss its employees' ERISA claims, arguing the plaintiffs' third amended class action complaint does not conform with prior court rulings.

EDS alleges its employees, who claim the company breached its fiduciary duties in the handling of its pension plan, ignored a Texas judge's orders by repleading claims either infected by “class conflicts” or previously dismissed by the court.
