Judge Tosses Coca-Cola's Suit Against Pepsi

Law360, New York (July 26, 2007, 12:00 AM EDT) -- A judge threw out a lawsuit by Coca-Cola Co. against rival soda maker Pepsi-Cola Co., ruling that Pepsi had not infringed Coca-Cola's patent on a bag that dispenses syrup for fountain sodas.

“It confirmed what we knew all along, that there was no infringement,” Pepsi spokesperson Dave DeCecco told Dow Jones news service.

Coca-Cola was reviewing the decision and an appeal may be forthcoming, according to Dow Jones. The company has 30 days to decide.
