Ga. Laws Don't Apply In Calif. Wage Class Action: 9th Circ.

Law360, New York (February 8, 2012, 5:21 PM EST) -- The Ninth Circuit ruled Wednesday that a California federal judge was wrong to use Georgia's more employer-friendly laws to dismiss an overtime class action against Affinity Logistics Corp., saying the state's laws directly conflict with California's system to protect workers.

The lower court erred when it ruled that hundreds of Affinity Logistics Corp. delivery drivers were independent contractors instead of employees entitled to overtime and other benefits, the three-judge panel said, because the court incorrectly applied Georgia's employee-contractor laws to the suit.
