Funeral Company Must Recognize Union Vote

Law360 (July 30, 2007, 12:00 AM EDT) -- An appellate court last Friday upheld a ruling by the National Labor Relations Board that a funeral home company had to accept the results of a union election, even though sample ballots had been altered to mislead workers into thinking the NLRB supported the union.

“We deny the petition and uphold the Board's order because it is supported by substantial evidence and is consistent with the Board's own precedent,” said Judge Thomas Griffith of the U.S. Court of Appeals for the D.C. Circuit in his opinion....
